These Terms & Conditions govern all bookings made with Space Studios. By making a booking, completing an online reservation or selecting "I have read and agree to the Terms & Conditions", you acknowledge that you have read, understood and agree to be legally bound by these Terms.

Space Studios reserves the right to amend these Terms from time to time. The Terms in effect at the time of booking will apply.

1. Definitions

Booking means any reservation made with Space Studios.

Client means the person or entity making the booking.

Studio means all areas, equipment, fixtures, fittings, furniture and facilities operated by Space Studios.

Guests includes all photographers, videographers, assistants, models, stylists, hair and makeup artists, contractors, suppliers, visitors and any other person attending under the Client's booking.

2. Booking Eligibility

The person making the booking must:

• be at least 18 years of age;

• have authority to enter into this agreement;

• be responsible for all persons attending under the booking; and

• ensure all guests comply with these Terms.

3. Booking Confirmation

Bookings are confirmed once payment (or any required deposit) has been received.

Space Studios reserves the right to decline any booking at its discretion.

4. Studio Hire Period

Your booking period includes:

• bump in;

• equipment setup;

• photography or filming;

• breaks;

• pack down; and

• bump out.

Clients must vacate the studio by the scheduled finish time.

Failure to vacate on time may result in overtime charges.

5. Overtime

If your booking exceeds the allocated hire period, overtime will be charged in 30-minute increments at 150% of the applicable hourly studio hire rate.

Overtime is subject to studio availability and cannot be guaranteed.

6. Payments

All hire fees must be paid prior to the booking unless otherwise agreed in writing.

Any additional charges incurred during the booking will be invoiced and must be paid within seven (7) days.

7. Security Bonds

Space Studios may require a refundable security bond.

Current bond amounts are:

• Standard studio hire: $500

• Events and exclusive venue hire: $1,500

Space Studios reserves the right to require a higher security bond depending on:

• booking duration;

• number of attendees;

• equipment being used;

• production risk; or

• any other relevant circumstance.

The bond will generally be refunded within five (5) business days following inspection of the premises, less any amounts reasonably required to cover:

• damage;

• repainting;

• cleaning;

• missing equipment;

• overtime;

• unpaid invoices; or

• other costs payable under these Terms.

8. Cancellations & Rescheduling

More than seven (7) days before the booking:

• Full refund or one complimentary reschedule.

Between 72 hours and seven (7) days:

• 50% cancellation fee; or

• one reschedule (subject to availability).

Less than 72 hours:

• No refund.

Failure to attend or cancellation within 24 hours:

• 100% of the booking fee is payable.

Space Studios may, at its discretion, allow alternative arrangements in exceptional circumstances.

9. Studio Access

Clients may only access the areas included within their booking.

Entry into restricted areas is prohibited unless authorised by Space Studios.

10. Maximum Occupancy

Clients must not exceed the maximum occupancy advised by Space Studios.

Space Studios reserves the right to refuse entry to additional guests.

11. Studio Care

The Client agrees to:

• leave the studio clean and tidy;

• remove all rubbish;

• return furniture and equipment to their original locations;

• report any damage immediately.

Furniture must not be dragged across the floors.

12. Cyclorama Walls

The white and black cyclorama walls are premium studio assets requiring specialist maintenance.

Clients must not:

• stand on the curved sweep unnecessarily;

• mark the walls;

• use dirty footwear;

• use sharp objects against the walls;

• apply adhesives, paints or liquids without approval.

Vehicles must not enter the cyclorama unless approved.

Tyres must be clean before entering.

Any tyre marks, oil contamination or damage may incur repainting costs.

13. Lighting, Truss & Rigging

Space Studios features a professional motorised truss system.

Clients must not:

• climb the truss;

• attach equipment to the truss;

• alter lighting positions;

• operate motors;

• modify electrical equipment.

Only authorised Space Studios personnel may operate the lighting and rigging system unless prior approval has been granted.

14. Equipment

Clients are responsible for all hired equipment during their booking.

Equipment must only be used for its intended purpose.

Any damaged or missing equipment will be charged at repair or replacement cost.

15. Vehicles

Vehicle access is permitted only with prior approval.

Vehicles must:

• travel at walking speed;

• not perform burnouts or aggressive manoeuvres;

• not leak fluids;

• not exceed weight limits advised by Space Studios.

Space Studios may refuse entry to any vehicle.

16. Cleaning

The studio must be returned in the condition it was found.

Additional cleaning charges apply where excessive cleaning is required.

17. Prohibited Materials

Unless approved in writing, the following are prohibited:

• glitter;

• confetti;

• fake snow;

• powder;

• flour;

• sand;

• dirt;

• paint;

• smoke machines;

• haze machines;

• candles;

• open flames;

• pyrotechnics;

• fireworks;

• nails;

• screws;

• staples;

• permanent adhesives.

Only approved low-tack tape may be used.

18. Smoking, Vaping & Alcohol

Smoking and vaping are prohibited inside the studio.

Alcohol is permitted only with prior approval.

Illegal drugs are strictly prohibited.

Any intoxicated person may be refused entry or removed.

19. Noise

Clients must keep noise to a reasonable level and comply with any directions provided by Space Studios.

20. Safety

Clients must comply with all Work Health & Safety requirements.

Emergency exits must remain unobstructed.

Children must be supervised at all times.

Unsafe behaviour may result in immediate termination of the booking.

21. Insurance

Clients are responsible for obtaining any insurance appropriate for their activities.

Commercial productions, workshops, public events or higher-risk bookings may be required to provide evidence of Public Liability Insurance with a minimum cover of $20 million.

22. Responsibility for Guests

The Client accepts full responsibility for all guests attending under their booking.

The Client is liable for any loss or damage caused by any guest.

23. Damage

The Client agrees to pay for any damage caused during the booking.

This includes damage to:

• cyclorama walls;

• flooring;

• lighting;

• truss;

• furniture;

• equipment;

• doors;

• amenities; and

• any other property belonging to Space Studios.

Repair costs may include labour, materials, replacement, freight and any specialist contractor costs.

24. Indemnity

The Client indemnifies and holds harmless Space Studios, its directors, employees and contractors from any claim, loss, liability, damage, cost or expense arising from:

• the Client's booking;

• the acts or omissions of the Client or their guests;

• damage caused during the booking; or

• breach of these Terms,

except to the extent caused by the negligence or unlawful conduct of Space Studios.

25. Limitation of Liability

To the maximum extent permitted by law, Space Studios is not liable for:

• loss of income;

• business interruption;

• consequential loss;

• damage to personal property;

• theft;

• equipment failure beyond reasonable control; or

• delays caused by circumstances outside its reasonable control.

Nothing in these Terms excludes rights that cannot be excluded under Australian Consumer Law.

26. Personal Property

All personal property remains at the owner's risk.

Space Studios accepts no responsibility for lost, stolen or damaged property.

27. Photography by Space Studios

Unless the Client requests otherwise in writing before the booking, Space Studios may capture behind-the-scenes photographs or video for promotional purposes, provided confidential or unreleased content is not intentionally featured.

28. Events

Bookings involving:

• public attendance;

• ticket sales;

• alcohol service;

• entertainment;

• external vendors; or

• other higher-risk activities

may require a separate Event Hire Agreement.

Space Studios reserves the right to determine whether a booking constitutes an event.

29. Right to Refuse Entry

Space Studios reserves the right to refuse entry or terminate a booking where:

• these Terms are breached;

• unsafe behaviour occurs;

• illegal activity occurs;

• information provided during booking is materially inaccurate; or

• the safety of persons or property is at risk.

Where a booking is terminated due to the Client's breach, no refund will be payable.

30. Force Majeure

Space Studios is not liable for any failure or delay in performing its obligations where such failure results from events beyond its reasonable control, including natural disasters, power outages, government restrictions or other unforeseen events.

31. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

The parties submit to the exclusive jurisdiction of the courts of New South Wales.

Schedule A – Fees

Current charges include:

Spot repaint (per cyclorama wall) $200 + GSTFull repaint (per cyclorama wall) $800 + GST

Excess cleaning from $150 + GST

Glitter, confetti, powder or prohibited material clean-up from $300 + GST plus cleaning costs

Damage to lighting at repair or replacement cost

Damage to truss or rigging at repair, certification and replacement costs

Damage to furniture at repair or replacement cost

Damage to flooring at repair cost

Lost key or access device at replacement cost

Overtime at 150% of hourly rate, charged in 30-minute increments

Space Studios reserves the right to recover all reasonable costs incurred where damage exceeds the amounts listed above.

Acceptance

By proceeding with an online booking and selecting "I have read and agree to the Terms & Conditions", you acknowledge that you have read, understood and agree to be legally bound by these Terms & Conditions.
